1. Introduction

1. 1.1These Terms apply to a User's use of the website www.hybridrubbermoreleta.co.za (“the Website”), operated by Hybrid Liquid Rubber SA – Moreleta Park (“HLR Moreleta Park”, “we”, “us” or “our”). By using this Website, a User agrees to accept the Terms contained herein.
2. 1.2Should a User not agree to the Terms contained herein, a User must immediately stop using this Website.
3. 1.3HLR Moreleta Park is an independently owned and operated franchise of Hybrid Liquid Rubber SA. Any order, quotation or service agreement arising from this Website is entered into with HLR Moreleta Park alone. The franchisor is not a party to that agreement and is not responsible for the workmanship of this branch, save for any manufacturer's product warranty given by the franchisor in its own name.
4. 1.4This Website is not intended for use by minors. If you are under 18, please browse the Website together with a parent or guardian.
5. 1.5This Website is an information, product catalogue and lead-generation tool. Nothing on the Website constitutes a binding quotation, contract, offer of sale, or guarantee of work. All pricing, stock availability, scope of work and guarantees are only binding once confirmed in a written, signed quotation, order confirmation or service agreement issued by HLR Moreleta Park.

2. Intellectual Property Rights

1. 2.1The Hybrid Liquid Rubber name, logo and trade marks are the property of Hybrid Liquid Rubber SA and are used by HLR Moreleta Park under licence as a franchisee. All other intellectual property rights and materials contained on this Website, including photographs of completed projects and written content, are owned by HLR Moreleta Park and/or its licensors.
2. 2.2A User is granted a limited, non-exclusive licence only for the purpose of viewing the Website, purchasing our products and requesting our services.

3. Restrictions

A User may not:

1. 3.1.1publish or mirror any of this Website's material in any media whatsoever;
2. 3.1.2use this Website for any objectionable or unlawful purpose, including posting any threatening, defamatory, obscene, scandalous, inflammatory, pornographic, profane or spam material through any form, review, or contact channel on the Website;
3. 3.1.3take any action that may impose an unreasonable or disproportionately large load on this Website's infrastructure;
4. 3.1.4use this Website in any manner that would result in a User breaching any applicable legislation (including with respect to privacy) or any obligation owed to a third party;
5. 3.1.5conduct any activity which compromises or breaches any third party's patent, trademark, copyright or other intellectual property rights;
6. 3.1.6introduce any virus, worm, trojan horse, malicious code or other program that may damage the Website or the Branch's systems;
7. 3.1.7engage in any data mining, data harvesting, data scraping or similar automated data-extraction activity in relation to this Website, other than indexing by recognised search engines (e.g. Google);
8. 3.1.8use this Website contrary to applicable laws and regulations, or in any way that may cause harm to the Website or to any person or business; or
9. 3.1.9use the Website's quote request, order, contact, or WhatsApp forms to send unsolicited advertising or marketing to HLR Moreleta Park.
10. 3.2Certain areas of this Website may be restricted, and HLR Moreleta Park may restrict a User's access to any part of the Website at any time, at its sole discretion.

4. Content You Submit

1. 4.1“User Content” means any text, images, testimonials, reviews, photographs (for example, of a property or damage), or other material a User submits via a quote request form, order request, contact form, WhatsApp message, or review platform. By submitting User Content, you grant HLR Moreleta Park a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content (for example, a testimonial or a before/after photo) for the purpose of providing our products and services and for reasonable marketing purposes.
2. 4.2User Content must be your own, accurate, and must not infringe any third party's rights. HLR Moreleta Park reserves the right to remove or decline to publish any User Content (such as a review) at its discretion.
3. 4.3Where a User submits photographs of a property to obtain an estimate, HLR Moreleta Park will only use those images to prepare the quotation and, where the User separately agrees, as a before/after reference for marketing.

5. Product Orders, Payment and Collection

1. 5.1Product listings, colour shades, pack sizes and prices shown on the Website are indicative only, and are subject to change and to stock availability. Colours displayed on a screen or in print may differ from the actual product; the colour wall in store is the reference.
2. 5.2Orders are placed by WhatsApp, phone, email or in store. The Website does not process online payments and is not an online shop. Payment is made directly to HLR Moreleta Park, and goods are collected from 870 Rubenstein Drive, Moreleta Park, Pretoria, unless delivery is separately agreed in writing.
3. 5.3An order is only accepted once HLR Moreleta Park confirms it in writing and, where required, payment has been received. We may decline or cancel an order where stock is unavailable or where a price has been displayed in error, in which case any amount already paid for that order will be refunded.
4. 5.4Products are supplied subject to the manufacturer's Technical Data Sheet (TDS) and Safety Data Sheet (MSDS) for the product concerned. A User is responsible for reading and following the surface preparation, application, coverage and safety instructions in those documents. Any product warranty is the manufacturer's warranty and applies only where the product has been stored, prepared and applied in accordance with the TDS.
5. 5.5Returns, refunds and defective goods are handled in accordance with the Consumer Protection Act 68 of 2008. Tinted, custom-mixed, decanted or opened products cannot be returned unless they are defective.

6. Links to Other Websites

1. 6.1This Website may contain links to other websites, including social media platforms such as Facebook and LinkedIn and the Hybrid Liquid Rubber SA national website. HLR Moreleta Park has no control over websites operated by third parties and is not responsible for, and has no liability in connection with, a User's access to or use of any third-party website.

7. No Warranties Regarding the Website

1. 7.1This Website is provided “as is”. HLR Moreleta Park makes no representations or warranties of any kind regarding the Website itself or the general information contained on it, including project photographs, product and service descriptions, coverage figures, and indicative pricing.
2. 7.2HLR Moreleta Park cannot guarantee that any file downloaded from, or delivered via, this Website will be free of viruses or other harmful code. Users are responsible for their own appropriate virus protection.
3. 7.3This clause does not limit or exclude the guarantees, warranties, or workmanship undertakings that HLR Moreleta Park provides in a signed, written quotation or service agreement for actual waterproofing, damp proofing, roofing, or painting work carried out at a User's property, nor any manufacturer's product warranty. Those undertakings are governed by the terms of that specific agreement or warranty, not by this clause.

8. Limitation of Liability and Indemnification

1. 8.1To the extent permitted by law, HLR Moreleta Park, and any of its officers, employees or subcontractors, will not be held liable for anything arising out of or connected with a User's use of this Website (as opposed to products actually supplied or services actually rendered under a signed quotation or order confirmation), whether such liability arises in contract, delict, or otherwise.
2. 8.2A User indemnifies HLR Moreleta Park and agrees to keep it indemnified from and against any claim, loss, damage, cost or expense that HLR Moreleta Park may suffer as a result of a User's improper use of, or conduct in connection with, this Website, including any breach of these Terms or any applicable law.
3. 8.3To the extent that HLR Moreleta Park's liability cannot be excluded by law, its maximum liability arising from use of this Website (as distinct from products supplied or services actually rendered) will be limited to the minimum amount permitted by such law.
4. 8.4Nothing in this clause limits any right a consumer has under the Consumer Protection Act 68 of 2008 in respect of goods supplied or services actually rendered by HLR Moreleta Park.

9. Severability

1. 9.1If any provision of these Terms is found to be invalid under applicable law, that provision will be deleted without affecting the remaining provisions of these Terms.

10. Variation of Terms

1. 10.1HLR Moreleta Park may revise these Terms at any time. Revisions take effect once posted on this Website, unless a later date is stated. A User's continued use of the Website after revisions are posted will be treated as acceptance of the amended Terms. If a User does not agree to amended Terms, their only remedy is to stop using the Website.

11. Assignment

1. 11.1HLR Moreleta Park may assign, transfer or subcontract its rights and obligations under these Terms without prior notice to Users. A User may not assign, transfer or subcontract any of their rights or obligations under these Terms.

12. Entire Agreement

1. 12.1These Terms constitute the entire agreement between HLR Moreleta Park and a User in relation to use of this Website, unless a more specific written quotation, order confirmation or service agreement has been entered into, in which case that agreement governs the products or services described in it.

13. Governing Law & Jurisdiction

1. 13.1These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.

14. Domicilium Citandi Et Executandi and Contact Information

1. 14.1A User and HLR Moreleta Park choose the following as their respective domicilium citandi et executandi for legal proceedings and for giving or sending any notice required under these Terms:
2. 14.1.1Hybrid Liquid Rubber SA – Moreleta Park: 870 Rubenstein Drive, Moreleta Park, Pretoria, 0044, South Africa.
3. 14.1.2User: the address, email, or phone number provided by the User when placing an order, requesting a quote or otherwise contacting HLR Moreleta Park.
4. 14.2Either party may change its domicilium to another physical or email address by written notice to the other. Such a change takes effect 7 (seven) days after receipt of the notice.
5. 14.3All notices under these Terms must be given in writing, delivered by email or, where agreed, WhatsApp, and will be presumed received on the date of delivery.
6. 14.4Any notice actually received will be treated as validly given, even if it was not delivered strictly in accordance with this clause.
